This Acceptable Use Policy ("AUP") sets out the rules for using the website at elevatemi.co.uk and its subdomains, and our products, tools and APIs (together, the "Services"), operated by Elevate Market Intelligence Limited (company number 16329736), registered office 6 Lucky Lane, Exeter, EX2 4UJ ("Elevate", "we", "us"). It applies to everyone who uses the Services and forms part of our Website Terms of Use and any product-specific terms. Where a product's own terms set additional or stricter rules, those also apply.

1. General principle

You must use the Services lawfully, honestly and only for their intended purposes. You must not use them in any way that breaks the law, infringes anyone's rights, or harms or risks harming us, our Services or other users.

2. Prohibited uses

You must not:

(a) use the Services in breach of any applicable law or regulation, including the UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 (PECR), direct-marketing rules, or any applicable export, sanctions or anti-fraud laws;

(b) use any data, outputs, insights or content obtained through the Services for any unlawful purpose, or in a way that infringes the privacy or other rights of any individual;

(c) send unlawful, unsolicited or deceptive marketing, or use the Services to facilitate spam, harassment or nuisance communications;

(d) upload, transmit or distribute any material that is unlawful, defamatory, obscene, abusive, discriminatory, infringing, or otherwise objectionable;

(e) introduce or attempt to introduce viruses, worms, malware or any other harmful code, or otherwise interfere with the proper working of the Services;

(f) attempt to gain unauthorised access to, test the vulnerability of, or disrupt the Services or any server, network, account or system connected to them, including by denial-of-service attacks;

(g) probe, scan, scrape, harvest or bulk-extract content or data from the Services except as expressly permitted, or exceed reasonable or stated usage or API limits;

(h) reverse engineer, decompile or attempt to derive the source code, underlying data sources or models of the Services, except to the extent the law does not allow this restriction;

(i) use the Services, or any data or outputs from them, to build, train or populate any product, dataset or model that competes with us, or to create a general-purpose database of our data;

(j) resell, sublicense, rent, share or otherwise make the Services or our data available to any third party except as expressly permitted in the applicable product terms;

(k) remove, obscure or alter any proprietary notices, or misrepresent your identity, your affiliation, or the origin of any content; or

(l) use the Services in any way that places an unreasonable or disproportionately large load on our infrastructure, or that could damage, disable or impair the Services.

3. Your content and data

3.1 You are responsible for all content and data you submit to, or process using, the Services, and for ensuring you have the rights and lawful basis to do so.

3.2 Where you connect third-party platforms or accounts to our Services, you confirm you are authorised to do so and to allow us to access and process the relevant data on your behalf as described in the applicable product terms and our Privacy Policy.

4. Monitoring and enforcement

4.1 We do not routinely monitor use of the Services, but we may do so where we reasonably need to, for example to protect the Services, comply with the law, or investigate suspected breaches of this AUP.

4.2 If you breach this AUP, we may take any action we consider appropriate, including issuing a warning, restricting, suspending or terminating your access or account, removing content, and reporting activity to the relevant authorities. We may act without notice where we reasonably consider prompt action necessary.

4.3 We are not liable for any loss you suffer as a result of action we take under this AUP, and you are responsible for any loss we suffer as a result of your breach of it.

6. Changes and governing law

We may update this AUP from time to time; the "Last updated" date shows when it last changed. This AUP is governed by the law of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.
