These terms of use ("Terms") govern your access to and use of the website at elevatemi.co.uk and its subdomains (the "Site"), operated by Elevate Market Intelligence Limited (company number 16329736), registered in England and Wales, registered office 6 Lucky Lane, Exeter, EX2 4UJ ("Elevate", "we", "us", "our"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover general use of the Site and our marketing content. Separate terms apply to our individual products and services (for example the Databank terms and the Close the Gap terms), and where those apply to what you are doing, they take precedence over these Terms for that product or service.

1. Who we are and how to contact us

The Site is operated by Elevate Market Intelligence Limited. You can contact us at [email protected] or +44 (0)1392 542 833. The Constant Media (TCM) is a trading name of Elevate Market Intelligence Limited.

2. Using the Site

2.1 You may use the Site for lawful purposes and in accordance with these Terms. The Site and its content are provided for general information and to tell you about our products and services.

2.2 We may update, change, suspend or withdraw all or part of the Site at any time, and we do not guarantee that the Site, or any content on it, will always be available or uninterrupted.

2.3 You are responsible for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

2.4 Your use of the Site is also governed by our Acceptable Use Policy, Cookie Policy and Privacy Policy.

3. Registration and accounts

3.1 Some parts of the Site, and our products, require you to register for an account. You must provide accurate information and keep it up to date.

3.2 You are responsible for keeping your account credentials confidential and for all activity carried out under your account. Tell us promptly if you believe your account has been compromised.

3.3 We may suspend or close your account if you breach these Terms or any product terms that apply to you.

4.1 We, or our licensors, own all intellectual property rights in the Site and in all content we publish on it, including text, graphics, logos, layout and software. These rights are protected by law and all such rights are reserved.

4.2 You may view, download and print content from the Site for your own internal reference, provided you do not modify it and you keep all copyright and other proprietary notices intact. You must not otherwise copy, reproduce, republish, distribute or commercially exploit any content from the Site without our written permission.

4.3 "Elevate", "Elevate Market Intelligence", "Databank", "Close the Gap", "Prospect Profiler", "The Signal" and "The Constant Media" are names and brands we use. You may not use them without our permission, except to refer to us fairly and accurately.

5. Our learning and educational content

Our Learn area, The Signal, glossary and other educational materials are subject to separate terms. Please see our Learn Terms and Disclaimer. In short: that content is general information, not professional advice, and you are responsible for how you use it.

The Site may contain links to third-party websites and resources, and may display content provided by third parties. We provide these for your convenience only and do not control, endorse or accept responsibility for them. Following a link is at your own risk and subject to the third party's own terms.

7. No advice and no reliance

7.1 The content on the Site is provided for general information only. It is not professional, legal, financial, marketing or other advice, and you should not rely on it as such. Where you need advice for a particular situation, you should consult a suitably qualified professional.

7.2 Although we make reasonable efforts to keep the Site up to date, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or current.

8. Availability and security

8.1 We do not guarantee that the Site will be secure or free from bugs, errors or viruses. You are responsible for configuring your own technology and using your own virus protection.

9.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

9.2 We provide the Site for domestic, private and general business information use. Subject to clause 9.1, we are not liable for any loss of profit, loss of business, business interruption, loss of revenue, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss arising out of or in connection with your use of, or inability to use, the Site.

9.3 Subject to clause 9.1, our total liability to you arising out of or in connection with the Site and these Terms (other than under product terms that set their own liability position) is limited to £100.

9.4 This clause 9 does not affect your statutory rights as a consumer, if you are using the Site as a consumer.

10. Changes to these Terms

We may revise these Terms at any time by updating this page. The "Last updated" date at the top shows when we last changed them. Your continued use of the Site after a change means you accept the updated Terms.

11. General

11.1 If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

11.2 We may transfer our rights and obligations under these Terms to another organisation. You may not transfer yours without our consent.

11.3 A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999.

11.4 These Terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree to the exclusive jurisdiction of the courts of England and Wales.
